App Terms of Use

These Terms of Use (“Terms”) govern your use of the Easy Cookie Decorating mobile application and all related services (“App”). By creating an account or using the App, you agree to be bound by these Terms. When you register, the date and version of these Terms are recorded with your account. Please read them carefully.

1 User Accounts

1.1 Eligibility and Minimum Age

You must be at least 13 years old to create an account or use Easy Cookie Decorating. If you are under the age of majority where you live, you may use the App only with the permission of a parent or legal guardian.

We do not knowingly permit children under 13 to create accounts. If we learn that a child under 13 has created an account or provided us with personal information, we will take reasonable steps to delete the account and associated personal information.

1.2 Account Registration

You agree to provide accurate, complete, and current information when creating your account, including your first name, username, and email address. You agree to keep this information up to date and to notify us promptly at [email protected] or through the in-app Help & Support feature if you discover any unauthorized access to your account.

1.3 One Account Per Person

Each person may register and maintain only one account. Creating multiple accounts to circumvent EasySnap credit limits, moderation actions, or account suspensions is prohibited and may result in termination of all associated accounts.

1.4 Account Non-Transferability

Your account is personal and non-transferable. You may not sell, assign, or share your account credentials with any other person. Purchased content, Masterclass access, and EasySnap credits are tied to your individual account.

1.5 Clickwrap Acceptance

By checking the box agreeing to these Terms and our Privacy Policy and then tapping “Create Account,” you affirmatively agree to be bound by these Terms and acknowledge our Privacy Policy. The date and version of the Terms you accepted are recorded with your account.

2 Password & Security Responsibilities

2.1 User Responsibility for Credentials

You are solely responsible for maintaining the confidentiality of your password and account. We are not liable for any loss or damage arising from your failure to protect your credentials. We use short-lived access tokens (15 minutes) and 90-day refresh tokens stored in encrypted device storage. If your device is lost or compromised, contact us immediately at [email protected] or through the in-app Help & Support feature to invalidate your sessions.

2.2 Immediate Notification of Breach

If you discover or suspect any unauthorized use of your account or any other security breach, you must notify us immediately at [email protected] or through the in-app Help & Support feature. Failure to notify us in a timely manner may limit our ability to assist you and may affect our respective liabilities for the breach.

2.3 Password Reset

If you forget your password, you may request a reset link via the “Forgot Password” screen. A reset link will be sent to your registered email address. Reset links expire after a short period for security. The App enforces a minimum password length of 8 characters.

2.4 Strong Password Recommendation

We strongly recommend using a unique password of at least 12 characters combining letters, numbers, and symbols. Do not reuse passwords across different services.

3 Acceptable Use

3.1 Permitted Uses

The App may be used for personal and commercial cookie decorating purposes, including creating and selling decorated cookies using AI-generated designs as a reference guide.

3.2 Prohibited Conduct

You agree not to:

Upload images you do not own or have permission to use.
Upload images containing unlawful, obscene, defamatory, threatening, or harassing content.
Upload images of other identifiable individuals without their consent.
Attempt to reverse-engineer, scrape, or extract the App’s AI models, prompts, or generation parameters.
Attempt to circumvent credit limits, rate limits, or access controls.
Use automated scripts, bots, or crawlers to interact with the App.
Impersonate another user or the operator, or post false or misleading information.
Use the App to generate content that facilitates illegal activity.
Reproduce, redistribute, or resell app content (lessons, tutorials, videos) for commercial purposes.

3.3 No Circumvention of Security

You must not attempt to probe, scan, or test the vulnerability of any system or network connected to the App, nor attempt to breach any security or authentication measures.

4 Community Rules & User-Generated Content

4.1 Community Content Rules

When posting to the community, your content must:

Be your own original work or content you have the right to share.
Not contain personal attacks, harassment, or hate speech.
Not include personal information about other individuals without consent.
Not include spam, advertising, or unsolicited promotions for third-party products.
Not infringe any third party’s copyright, trademark, or intellectual property rights.
Not contain nudity, sexually explicit material, or graphic violence.
Be related to cookie decorating or the App’s subject matter.

4.2 License Grant for User-Generated Content

By posting content to the community, you grant Easy Cookie Decorating a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to display, reproduce, and distribute your content for the purpose of operating, promoting, and improving the App. This license survives deletion of the content.

4.3 You Retain Ownership

You retain full copyright ownership of your original community posts, comments, and uploaded images. The license above is limited to operating the App and does not transfer ownership to us.

4.4 Self-Delete and Reporting

You may delete your own posts and comments at any time using the trash icon visible on your content. You may report content that violates these Terms using the flag icon. We review reports and reserve the right to remove content that violates these Terms at our sole discretion, without notice.

4.5 Public Visibility

Community posts and comments are publicly visible to all users including unauthenticated visitors. Images attached to comments are accessible to anyone with the URL. After account deletion, your posts and comments are anonymised and attributed to “[deleted]” rather than removed, in order to preserve conversation continuity.

4.6 No Pre-Screening

We do not pre-screen user-generated content and are under no obligation to monitor the community at all times. However, we reserve the right to remove any content that violates these Terms.

5 EasySnap Cookie Designer™ — Use, IP & Restrictions

5.1 Nature of the Service

EasySnap Cookie Designer™ creates simplified, cookie-friendly artwork inspired by a user-submitted photo. It does not produce an exact reproduction of your photo. Details may be simplified, backgrounds may be removed, and complex elements may be adjusted to produce a clean, decoratable design.

5.2 AI Processing Disclosure

When you use EasySnap, your uploaded photo is transmitted to OpenAI’s API for AI processing. OpenAI may retain API inputs for up to 30 days for safety monitoring. OpenAI does not use API inputs to train their models. We have no control over OpenAI’s data retention practices. See our Privacy Policy for full details.

5.3 Photo Storage and Deletion

Uploaded photos are temporarily stored in secure cloud storage (Google Cloud Storage) for up to 24 hours while your design is generated, then automatically and permanently deleted. Generated designs (Color Guide and Projector Template) are stored in your account until you delete them.

5.4 Results Are Not Guaranteed

EasySnap AI outputs vary based on the content, composition, lighting, and quality of your submitted photo. We do not guarantee any specific outcome, aesthetic quality, accuracy, or usability of the generated design. Results depend on third-party AI models and may change as those models are updated.

5.5 Human Faces

The EasySnap system is configured to simplify or remove human facial features from generated outputs. Uploading a photo of a person will produce a shape- and color-based design rather than a facial likeness. This is both a technical design choice and a privacy protection. You are solely responsible for ensuring you have the right to use any image depicting an identifiable person.

6 Uploading Copyrighted Images, Logos & Licensed Characters

6.1 Your Responsibility for Upload Rights

You are solely responsible for ensuring you have the legal right to upload any image to EasySnap. This includes rights to use any person, object, artwork, logo, trademark, or copyrighted content depicted in the image for the purpose of generating a derivative cookie design.

6.2 Copyrighted Photographs

Uploading a copyrighted photograph owned by a third party (stock photos, professional photographs, published images) without permission is prohibited. EasySnap produces a derivative work from your uploaded image; creating an unauthorized derivative work may constitute copyright infringement separate from reproducing the original.

6.3 Celebrity and Public Figure Photos

Uploading photos of celebrities, public figures, or any identifiable person without their consent is at your own risk. Using a generated cookie design depicting a recognizable likeness in a commercial context may violate that person’s right of publicity, regardless of whether the original photo was publicly available. We expressly disclaim all liability arising from uploads of images of real people.

6.4 Licensed Characters and Branded Content

Uploading images of characters, artwork, logos, or other content protected by third-party intellectual property rights — including Disney, Pokémon, Marvel, sports team logos, and similar — without a license from the rights holder is prohibited. Generating and selling cookie designs based on licensed characters without authorization may expose you to copyright infringement and trademark claims from the rights holder. We expressly disclaim liability for any such claims.

6.5 Logos and Trademark-Protected Images

Uploading trademark-protected imagery is permitted only when you have the right to use that trademark in the intended context. Generating a cookie design featuring another company’s logo for commercial sale without authorization may constitute trademark infringement. You bear full responsibility for any such use.

6.6 DMCA / Copyright Takedowns

We do not proactively screen uploaded images for copyright status. If you believe content stored in the App infringes your copyright, please contact us at [email protected] or through the in-app Help & Support feature with the subject “DMCA Takedown Request” and provide: (a) identification of the copyrighted work, (b) identification of the infringing content, (c) your contact information, and (d) a statement that the complaint is accurate and made in good faith. We will respond promptly to valid requests.

6.7 No Operator Liability for User Infringement

We are not liable for any copyright, trademark, right of publicity, or other intellectual property infringement committed by a user through the use of EasySnap. You agree to indemnify and hold us harmless for any claims arising from your uploads. See Section 17.

7 AI-Generated Cookie Designs — Ownership & License

7.1 IP Status of AI-Generated Content

As of 2024–2026, the US Copyright Office has held that purely AI-generated content — created entirely by AI without sufficient human authorship — is not eligible for copyright protection. This means that Color Guides and Projector Templates generated by EasySnap may not be protectable under copyright law. We do not claim copyright ownership of generated designs.

7.2 Your Rights in Generated Designs

You receive a non-exclusive right to use generated designs for personal and commercial cookie decorating. To the extent any copyright subsists in a generated design due to the creative contribution of your original photo, that interest is assigned to you. We retain the right to use anonymized, non-personally-identifiable design data to improve the service. You must not represent AI-generated designs as your own original hand-drawn artwork.

7.3 No Guarantee of Uniqueness

Because EasySnap uses AI models with similar prompts for similar inputs, multiple users may receive similar or identical outputs. We do not guarantee that any generated design is unique, and you should not assume you hold an exclusive right to a given design.

7.4 Permitted and Prohibited Commercial Uses

Generated designs MAY be used to:

Create and sell decorated cookies for individual or commercial orders.
Use as a reference or tracing guide during the decorating process.
Share images of completed cookies on social media.

Generated designs may NOT be used to:

Sell, redistribute, or license the Color Guide or Projector Template image files themselves as standalone digital products.
Train competing AI models.
Create merchandise beyond the cookie context (fabric, phone cases, etc.) without separate authorization.
Reproduce licensed or trademarked third-party content in commercial cookies without the rights holder’s permission.

8 Intellectual Property Ownership (App)

8.1 App Ownership

The App and all its content — including software code, UI design, branding, lesson materials, glossary entries, tutorial videos, decorating guides, Cookie of the Day selections, and the EasySnap Cookie Designer™ name and trade dress — are the exclusive property of Easy Cookie Decorating. Nothing in these Terms transfers any ownership interest to you.

8.2 EasySnap Cookie Designer™ Trademark

“EasySnap Cookie Designer™” is a trademark of Easy Cookie Decorating. You may not use this name in any way that suggests our endorsement, sponsorship, or affiliation with any product, service, or business without prior written permission.

8.3 No Implied License

No license or right to use our intellectual property is granted by these Terms except as expressly stated. Use of the App does not grant you the right to reproduce, redistribute, or create derivative works from App content (lessons, tutorials, decorating guides) for commercial purposes.

8.4 Feedback and Suggestions

If you submit feedback, ideas, or suggestions through the App — including via Help & Support — we may use that feedback for any purpose without compensation or attribution. You waive any intellectual property claims in such submissions.

9 Masterclass Content & License

9.1 License to Access

Upon purchasing access to a Masterclass video, you receive a limited, non-exclusive, non-transferable, non-sublicensable license to view that content through the App for personal, non-commercial use. This license does not include the right to download, record, copy, redistribute, broadcast, or publicly screen the content.

9.2 No Unauthorized Recording or Distribution

Masterclass videos are streamed through the App. You may not download, screen-record, or store these videos outside the App. Distributing recorded Masterclass content — whether for free or for sale — is a violation of these Terms and may constitute copyright infringement.

9.3 Refunds for Video Purchases

Masterclass video purchases are processed through the Apple App Store or Google Play Store. Refund eligibility is governed by Apple’s and Google’s refund policies, not by us. We are unable to issue refunds for App Store or Play Store purchases. Contact Apple or Google directly for refund requests.

9.4 Content Availability May Change

We reserve the right to modify, update, or remove Masterclass content at any time without notice. Purchasing access to a video does not guarantee permanent availability of that exact version of the content.

10 Purchases, EasySnap Credits & Refunds

10.1 What EasySnap Credits Are

EasySnap credits are virtual items that enable use of the EasySnap Cookie Designer™ feature. Credits are available in packs of 5, 15, or 50. Each credit entitles you to one complete EasySnap generation (one Color Guide and one Projector Template).

10.2 Credits Are Non-Refundable

EasySnap credits are non-refundable once purchased. Credits are deducted when a generation begins successfully — because AI processing resources are used immediately, credits cannot be returned after a generation attempt starts, regardless of output quality.

10.3 Automatic Refund on Technical Failure

If a generation attempt fails due to a technical error on our side (server error, AI service unavailability), the consumed credit is automatically refunded to your balance. This refund is automatic; you do not need to contact support.

10.4 Credits Do Not Expire

EasySnap credits do not expire. They remain in your account indefinitely until used, or until your account is terminated.

10.5 Credits Are Non-Transferable

Credits are personal to your account and may not be transferred to another account or redeemed for cash.

10.6 Credits Upon Account Termination

If your account is terminated by us for violation of these Terms, or if you delete your own account, all unused EasySnap credits are forfeited without refund. Because credits are purchased through the App Store or Play Store, we have no ability to issue cash refunds for forfeited credits.

10.7 App Store Refund Policy

All EasySnap credit pack purchases are processed by Apple (iOS) or Google (Android). Refund eligibility is determined entirely by their respective refund policies. We have no ability to override App Store or Play Store refund decisions.

11 RevenueCat & App Store Policies

11.1 Payment Processor Disclosure

In-app purchases are processed through Apple App Store (iOS) and Google Play Store (Android), managed via RevenueCat. By making a purchase, you agree to Apple’s and Google’s terms of service in addition to these Terms.

11.2 RevenueCat Data

RevenueCat receives your subscriber identifier and purchase transaction data to manage purchase verification and entitlements. RevenueCat’s privacy policy governs how RevenueCat processes this data (revenuecat.com/privacy).

11.3 Restore Purchases

If you reinstall the App or switch devices, you may restore previously purchased Masterclass access or EasySnap credits using the “Restore Purchases” feature in the App. Restoration is subject to verification by Apple or Google.

12 Affiliate Links (Amazon)

Easy Cookie Decorating participates in the Amazon Services LLC Associates Program, an affiliate advertising program designed to provide a means to earn advertising fees by advertising and linking to Amazon.com. Links in the Supply Hub and Recommended Tools sections may be Amazon affiliate links. We may earn a small commission on qualifying purchases at no additional cost to you.

When you tap an affiliate link, your device opens Amazon’s website and Amazon’s own privacy and tracking policies apply. We do not transmit your personal data to Amazon. All affiliate links are identified in the App with an appropriate disclosure label.

13 Community Moderation & Account Suspension

13.1 Our Right to Moderate

We reserve the right to remove any community post, comment, or image that we determine in our sole discretion violates these Terms, applicable law, or community standards — without prior notice and without liability to you.

13.2 Reporting

You may report content you believe violates these Terms using the flag icon on any post or comment. We review all reports. Submitting false or malicious reports is itself a violation of these Terms.

13.3 Warnings and Suspension

We may warn, temporarily suspend, or permanently terminate accounts that repeatedly or seriously violate these Terms. In cases of severe violations (illegal content, harassment, IP infringement), we may act without prior warning.

13.4 Appeals

If you believe your account was suspended or content removed in error, contact us at [email protected] or through the in-app Help & Support feature. We will review your appeal and respond in a reasonable timeframe, though we are not obligated to restore suspended accounts or removed content.

14 Account Termination

14.1 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any conduct we determine to be harmful to other users or the App.

14.2 Deletion by You

You may delete your account at any time from Profile → Delete Account. Account deletion immediately and permanently deletes:

Your login credentials, active sessions, and refresh tokens.
Your behavioral data, favorites, and push notification tokens.
Your EasySnap designs and their stored images (purged from cloud storage within 24 hours).
Your community posts and comments are anonymised and attributed to “[deleted]” to preserve conversation continuity. Unused EasySnap credits are forfeited upon deletion.

14.3 Effect of Termination

Upon termination, your right to use the App immediately ceases. Provisions of these Terms that by their nature should survive termination (Sections 6, 7, 8, 15, 16, 17, 18) will continue to apply.

15 Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES. AI-GENERATED DESIGNS ARE PROVIDED WITHOUT ANY WARRANTY AS TO ACCURACY, QUALITY, SUITABILITY, OR FITNESS FOR ANY PURPOSE. YOUR USE OF THE APP IS AT YOUR OWN RISK.

16 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL EASY COOKIE DECORATING, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, SERVICE INTERRUPTIONS, COMPUTER DAMAGE, OR COSTS OF SUBSTITUTE SERVICES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) US $10.00. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.

17 Indemnification

You agree to defend, indemnify, and hold harmless Easy Cookie Decorating and its officers, directors, employees, and agents from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from or relating to:

Your use of the App or any violation of these Terms.
Your community posts, comments, or uploaded images.
Any images you upload to EasySnap, including any intellectual property infringement, right-of-publicity violation, or other claim arising from the content of your uploads or the use of generated designs.
Your violation of any applicable law or third-party rights.

18 Governing Law & Dispute Resolution

18.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law principles. If you are located in the European Union, mandatory consumer protection laws of your country of residence may also apply.

18.2 Informal Resolution

Before filing any formal legal claim, you agree to contact us at [email protected] or through the in-app Help & Support feature to attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days of receiving your notice.

18.3 Binding Arbitration

If informal resolution fails, any dispute, claim, or controversy arising from or relating to these Terms or the App shall be resolved by binding individual arbitration, not in a court of law. You waive your right to participate in a class action lawsuit or class-wide arbitration. This arbitration clause does not prevent you from bringing a claim in small claims court for disputes within that court’s jurisdiction.

18.4 EU and UK Users

If you are a consumer residing in the EU or UK, you may have the right to bring claims before the courts of your country of residence and to benefit from mandatory consumer protection provisions that cannot be waived by contract. Nothing in these Terms affects those rights.

19 Changes to These Terms

We may update these Terms from time to time. Material changes will be announced via in-app notification. The “Last updated” date at the top reflects the most recent revision. Your continued use of the App after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App and may delete your account.
